If Trump Doesn't Concede

What happens if President Donald Trump does not concede the election? It's happened twice in U.S. history.

1) Concession speech is not required by law. It's just a custom.

The concession speech is a white flag of surrender. But it's not required in the constitution. Once a president concedes, the battle is over. It's a rubber stamp. Electors get together and cast their votes in D.C. The president is officially elected, and the votes are certified. and that certification gives that man the presidency.

But more importantly the concession speech from his opponent gives him legitimacy and a transfer without drama.

Twice in our history, the president did not concede the election. They knew something was off, and they weren't ready to give up the fight with a margin of less than 1% in all of the battleground states.

PA will be recounted. AZ is being counted. NV will be recounted. After that recount, the president has legal options. He can go to court to prove irregularities.

If that doesn't work, and the president still won't concede the election, Amendment 12 of the Constitution says that if 1) they can't rule on it in the court and 2) the president doesn't concede and 3) there's no certification of an undisputable majority, then we go to the House of Representatives.

475 members of the house. The numbers do not matter any longer. The election becomes obsolete. Now, the congress (House of Representatives) will elect the president. Each state in the congress gets one vote for the president. There are 50 states in the house. Of those 50, 37 are republican. Then, they will vote in the next president.

Trump may get tired of the fight. But he has a constitutional remedy to his dilemna. Remember, Hillary Clinton told Biden "Do not concede, no matter what". She knows this.

6:40 And so, Joe Biden has won a few battleground states by less than 1%. Those are automatic recounts. We will not have a winner until we have a certification.
If we can't get a certification, that's not contested in the courts, it will go to the House of Representatives just before inauguration day.

The constitution made a way for an illegitimate election to be overturned.
